Affidavit submitted before Misra Commission (1987).
I, Kusam Lata Jain, aged 45 years, wife of Shravan Kumar, resident of S-164A, School block, Shakarpur, Delhi solemnly affirm that:-
1. The news of death of our beloved Prime Minister on 31.10.84 shocked me very much. I am a Congress worker. To condole her death I went to the house of Jagjit Singh who is a Congress Leader and resides at S-364, School block, Shakar pur. There I found Bachittar Singh, Trilochan Singh, his mother, Tirath Singh, Gurdial Singh, Gurmel Singh, Amrik Singh, and his brother, Sodhi, Swaran Singh and Jit Singh. They had all come to condole the death of Shrimati Indira Gandhi. There were a large number of Hindus also-nearly 400/500. I came back home after half an hour.
2. On 1.11.1984 there was a great hue and cry at about 9.00 a.m. On hearing the noise, I came out. I found that a mob of 200/300 people armed with iron rods, swords and lathis was following two Sikhs. They were shouting, “ kill these Sikhs”. I went forward to find out the facts and was told by some one from the mob that the mob has killed innocent Sikhs. There was a noise again. I went forward and saw a big mob. I know many of them and they all entered the house of Bachittar Singh when we saw that those people dragged Bachittar Singh and another person out of the house and began to beat them with lathis. They also killed by beating with lathis his neighbours, Nirmal Singh, his father, Balwant Singh and Joginder who were at that time in his house. They then burnt all of them by dousing them in petrol and kerosene. This frightened us and we came back.
3. In the meanwhile, Haroo Singh’s gang began advancing towards the main road of school block. Thereafter, we came to know that the mob had also burnt Trilochan Singh and Tirath Singh. When I went there, I saw both of them burning badly which scene I could not bear. A little while after, information came that Haroo Singh’s gang had gone in the street of Mr. Singhal where there is the house of Gian Singh near the hotel there. There they had burnt Gian Singh, Angad Singh and their two tenants by placing all of them one upon another. I was at a loss to understand what was happening. At that time a police van came from the road near the school. R.D.Malhotra and Mool Chand S.P. were in the van. They told the gang that we are standing on the road ten steps away and you continue with your work.
4. The gang advanced further while making noise and began stoning the closed door of the house of Sikhs adjoining Gurdwara School block. After breaking their door, they entered the house. They dragged out Swaran Singh and his son Jit Singh from that house, put them in the truck parked outside their house and burnt them by sprinkling petrol around the truck, I saw all this from Rana’s house.
5. The gang then proceeded towards the children’s school, where there was the house of a Sikh. Half of the gang surrounded the house from both sides and dragged out two Sikhs after breaking the lock. They beat them with iron rods and sticks and burnt them after pouring oil on them.
6. Here below are the names of the people comprising the mob, whom I can recognize:
i) Haroo Singh s/o Faujdar resident of 299, School Block;
ii) Shyam Kishore s/o Haroo singh;
iii) Shyam Narain Kishore – Nehru Enclave;
iv) Jodhan;
v) Phool Vati Jha;
vi) Rajinder;
vii) Shyam Singh, Tyagi;
viii) Kalloo Barber;
ix) Madan Scooter operater;
x) Tilak Raj Mistri;
These people were leading the mob. I know all of them personally. There were innumerable other persons whose names I do not know. Haroo Singh was arrested a number of times but he is released on bail every time. I am enclosing his police record alongwith this statement.
