Affidavit submitted before Misra Commission (1987).
Affidavit of S. Gurcharan Singh s/o Late Kalyan Singh aged 40 years, r/o House No.4227, Gali Gurdwara No.10, Ajit Nagar, Gandhi Nagar, Delhi-31, presently residing at House No.9/3269, Gali No.6, Dharampura, Gandhi Nagar, Delhi-31.
I, the deponent above-named do hereby solemnly affirm and state on oath as under: –
1. On Oct.31, 1984 the bazaar closed at the news of assassination of Shrimati Indra Gandhi. At that time I was at my house. Nothing untoward happened till evening.
2. On 31-10-1984 some people gathered as mob and set fire to the Gurdwara. We 4/5 persons entered the Gurdwara from the back side (from the side of Gali No.12) when it was still burning and we brought home the Holy Granths.
3. Thereafter nothing happened and nobody came till the evening of Nov.1, 1984.
4. On Nov.1, 1984 at about 11 PM some Gujjars and Mazhabis gathered and set ablaze the house of my brother S. Satnam Singh residing in Gali No.11. The persons who set his house on fire were: –
a. Prabha Dairy Wala.
b. Two brother-in-laws (wife’s brother’s sons) of Prabha.
c. Sethi Dairy Wala.
d. Jai Raj.
e. Sethi’s brother Bheem Gujjar.
5. On Nov.2, 1984 at 5 AM I went to rescue Satnam Singh because we had learnt that his house had been set on fire. At that time Satnam Singh was hiding in another house.
6. When Satnam’s mother and father went to rescue Satnam, the latter revealed the names of aforesaid persons stated in Para 4 above who had burnt his house. He told that earlier those persons had also threatened him.
7. At that time when Satnam Singh was revealing the names of the culprits stated hereinabove, some of them were present there. They incited others to set ablaze the house of Kalyan Singh (elder brother of Satnam Singh) also.
8. On November 2, 1984 at about 7 AM we took Satnam Singh his wife and children to our house.
9. The mob gathered again at 9 AM and attacked my house. There were about 700 – 800 persons in the mob. They had iron rods, lathis etc. in their hands.
10. The mob started massive brick batting. Therefore we went into the adjoining house. At the same time my house was also set ablaze.
11. My father S. Kalyan Singh made repeated hand folded request to take away whatever they like but to spare them. The mob asked him to come out and no harm will be done to him. Kalyan Singh, sixty years old man came out with folded hands but some one among the mob threw petrol / chemical upon him and set him on fire.
12. Satnam Singh came out to his rescue. He was also hit by stones and fell down. The mob started piercing his eyes with sharp iron rods and at the same time, set him on fire after throwing some powder over him body. When I came out to their rescue, the criminals stated above in Para 4 namely.
1. Prabhu Dairy Wala, 2. Two brother in laws of Prabhu, 3. Sethi Dairy Wala, 4. Jai Raj, 5. Bheem Gujjar.
were all standing outside. Some body among them pounced upon me and snatched away Rs.1100/-lying in my pocket. They tried to throw the powder upon me but I ran into the same house.
13. By that time mob had set that house ablaze. That house belonged to Mohinder Singh. On seeing the raging fire Mohinder Singh came out and somebody stabbed him with knife. He fell down. When Mohinder Singh’s father came to his rescue, somebody broke his leg by an iron rod blow and he fell down unconscious there itself.
14. Mohinder Singh’s brother namely Bhajan Singh was also burnt by somebody. He died in Hospital three days thereafter.
15. Myself and two sons of Mohinder Singh hid in the house. The house was on fire. We lay down flat on the ground. We remained inside the house upto about 3 O’clock.
16. After the mob had left all three of us came out and saw the dead bodies. Police van came and Mohinder Singh, his father, Satnam Singh, Bhajan Singh and the Granthi (Priest) of the Gurdwara were taken in it.
17. Afterwards the police got Mohinder Singh and his father admitted in Irwin Hospital. At that time I was with them and remained with them on the night of November 2.
18. On Nov.3, 1984 I came to the Gandhi Nagar Police Station Camp. From there I came to Gurdwara Singh Sabha Gandhi Nagar on Nov.5. My entire family was already there.
